Terms of Service

Hey there! These Terms of Service ("Terms") are the rules of the road for using OctoPie AI and everything that comes with it (the "Service"), built and operated by Octavius AI, Inc. ("Company," "we," "us," or "our"), a Delaware C-Corporation.

By signing up or using OctoPie, you're agreeing to these Terms. We tried to keep them human-readable, but they're still legally binding, so please give them a read.

1. What OctoPie Is

OctoPie is an AI-powered business process management platform designed for real estate professionals. It includes AI-assisted contact management, lead tracking, engagement scoring, pipeline tools, personalized landing pages, iMessage integration, and automated follow-up workflows. Think of it as your AI agent that never sleeps.

2. Account Registration & Identity Verification

To use OctoPie, you need to create an account with accurate, truthful information. Here's what matters:

• You must be 18 or older to create an account.
• One account per person. Each account must belong to a real individual. No duplicate accounts, shell accounts, or accounts created on behalf of others without authorization.
• Real phone number required. Every account is locked to a unique, verified mobile phone number. This is how we keep the platform clean and trustworthy for all users. Your phone number cannot be shared with or transferred to another account.
• No VoIP, Google Voice, or internet-based phone numbers. We require a real carrier-based mobile number (AT&T, Verizon, T-Mobile, etc.). Virtual numbers, VoIP services (Google Voice, TextNow, Sideline, Grasshopper, etc.), and disposable/burner numbers are not permitted. If your number is flagged as VoIP, you'll need to use a real mobile number instead.
• One phone = one account, forever. Once a phone number is associated with an account, it cannot be reused to create a new account. This prevents trial abuse and protects the community.
• You're responsible for your account. Keep your credentials safe. Everything that happens under your login is on you.

3. Free Trial

New accounts get a 14-day free trial with full access to OctoPie's features. No credit card required to start.

• The trial starts the moment you create your account.
• Each person is entitled to one free trial, ever. Creating multiple accounts to get additional trials is a violation of these Terms and will result in all associated accounts being terminated.
• When your trial ends, you'll need to pick a paid plan to keep using the Service. Your data stays safe — we don't delete anything during the grace period.
• We reserve the right to modify or discontinue the free trial at any time.

4. Subscription and Payment

Plans: OctoPie is available at $79/month (Starter), $197/month (Pro), or $497/month (Team). Founding members may have locked-in pricing — that's yours to keep as long as your subscription stays active.

Billing: Payment is processed securely through Stripe. Your subscription renews automatically each billing period unless you cancel before the renewal date.

Refunds: We handle refunds on a case-by-case basis. Reach out to support and we'll work with you.

Cancellation: You can cancel anytime from your dashboard or by contacting us. Your access continues through the end of your current billing period.

5. Your Data & Your Contacts

Let's be crystal clear: your contacts are yours.

• Ownership: You own all the contact data, notes, and content you put into OctoPie. We will never sell, share, or use your contacts for our own marketing. Period.
• Access: You can view, export, or delete your contacts at any time from your dashboard.
• Processing: We process your data only to provide OctoPie's features — AI scoring, engagement tracking, automated follow-ups, etc. This is covered by our Privacy Policy.
• Visibility: Your contacts are isolated to your account. No other user can see your database. Our admin tools allow us to see aggregate usage metrics (like how many contacts you have) to provide support, but we don't browse your actual contact details without your explicit request.
• Deletion: If you close your account, you can request full deletion of all your data. We'll process that within 30 days.

6. Anti-Fraud & Fair Use

We built OctoPie to help real agents grow real businesses. To keep it that way:

• No gaming the trial system. Creating multiple accounts, using fake identities, spoofing phone numbers, or any other scheme to extend or repeat free trials will result in immediate and permanent termination of all associated accounts.
• We log fraud attempts. VoIP signups, phone number reuse attempts, and suspicious registration patterns are logged for security review. We use this data solely to protect the platform.
• Account sharing is not allowed. Your account is for your individual use. If you need access for team members, use our Team plan which supports multiple agents.
• Automated abuse. Using bots, scripts, or automated tools to create accounts, scrape data, or manipulate engagement metrics is prohibited.

7. Acceptable Use

Don't be that person. You agree not to:

• Use OctoPie for anything illegal or sketchy
• Spam people or send bulk unsolicited messages using data from the Service
• Try to hack, reverse engineer, or break into our systems
• Collect or store personal data about people without their knowledge or consent
• Interfere with or disrupt the Service for other users
• Resell, sublicense, or white-label OctoPie without written permission
• Misrepresent your identity or impersonate another person
• Use the platform in ways that could harm other users or damage the OctoPie brand

8. Intellectual Property

OctoPie — the software, algorithms, designs, branding, and content — belongs to Octavius AI, Inc. You get a limited, non-exclusive license to use it while your account is active. You retain ownership of everything you put in.

9. AI-Generated Content

OctoPie uses AI to generate engagement scores, sentiment analysis, follow-up recommendations, and other insights. These are decision-support tools — they're smart, but they're not perfect. Use your professional judgment alongside our AI outputs. We don't guarantee the accuracy of any AI-generated content.

10. Availability

We work hard to keep OctoPie running smoothly, but we can't guarantee 100% uptime. We may update, modify, or temporarily take down features for maintenance. If anything major changes, we'll let you know via email or in-app notification.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCTAVIUS AI, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

If your use of OctoPie causes a problem (legal or otherwise), you agree to cover us. You'll indemnify and hold harmless Octavius AI, Inc. and its team from any claims, damages, losses, or expenses that come from your use of the Service or violation of these Terms.

13. Termination

You can cancel and walk away anytime. We can also suspend or terminate your account if you violate these Terms, engage in fraud or abuse, or fail to pay. When your account is terminated, your access stops immediately. Your data is retained for 30 days in case you change your mind, then permanently deleted upon request.

14. Geographic Availability

The Service is available throughout the United States. We reserve the right to restrict access in certain areas at our discretion. Trying to get around geographic restrictions is a Terms violation and can result in instant account termination.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the date at the top and notify you via email or in-app. Continued use after changes means you accept the new Terms. If you disagree with any changes, your remedy is to cancel your account.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in Delaware state or federal courts.
